Terms of Service for BSPKN (Bespoken Directive) digital marketing services and growth systems, including the BSPKN Propel OS Alerts SMS program terms.
By accessing or using the website located at bspkn.co and all associated subdomains (collectively, the "Site"), you agree to be bound by these Terms of Service ("Terms"). The Site is operated by Bespoken Management LLC ("BSPKN," "we," "us," or "our"), a Minnesota limited liability company based in Wayzata, Minnesota.
If you do not agree to these Terms, do not use the Site. We reserve the right to update these Terms at any time. Continued use of the Site after changes constitutes acceptance of the revised Terms.
BSPKN provides digital marketing services for health and wellness businesses, including but not limited to search engine optimization, paid media management, website development, CRM implementation, and content strategy. The Site provides information about our services, tools, and resources including Peek (website audit), Pulse (client portal), Plan (scheduling), and other products within the Propel ecosystem.
Access to specific tools and platforms may require separate agreements, accounts, or subscriptions. Those services are governed by their respective terms in addition to these Terms.
You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:
The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Bespoken Management LLC, its licensors, or other providers and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
The BSPKN name, logo, Propel, Propel OS, Peek, Predict, Pulse, Proxy, Prologue, Premier, Plan, and all related names, logos, product and service names, designs, and slogans are trademarks of Bespoken Management LLC. You must not use such marks without our prior written permission.
Clients who engage BSPKN for services retain ownership of deliverables produced under their service agreement, including content, websites, data exports, and CRM workflows. Clients do not retain access to proprietary platform tools (Pulse, Predict, Proxy, Plan, Premier) upon termination of services. Specific ownership terms are governed by each client's individual service agreement.
Certain products or services available through the Site may require payment. All payments are processed through Stripe. By making a purchase, you agree to provide current, complete, and accurate purchase and account information. You agree to promptly update your account and payment information so that we can complete your transactions and contact you as needed.
All sales are final unless otherwise specified in a written service agreement. Refund policies, if applicable, are outlined in your individual service contract.

The Site may contain links to third-party websites or services that are not owned or controlled by BSPKN. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that BSPKN shall not be responsible or liable for any damage or loss caused by or in connection with use of any such content, goods, or services available through any such websites or services.
The Site is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. BSPKN does not warrant that the Site will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Site or the server that makes it available are free of viruses or other harmful components.
Marketing results referenced on the Site (including case studies, statistics, and testimonials) represent outcomes achieved for specific clients under specific circumstances and are not guarantees of future performance.
To the fullest extent permitted by applicable law, in no event will Bespoken Management LLC, its affiliates, officers, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Site.
You agree to defend, indemnify, and hold harmless Bespoken Management LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site.
These Terms shall be governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Hennepin County, Minnesota.
